BLOOMING SOUL – TERMS OF SERVICE AGREEMENT

Location: Shelburne, Ontario, Canada
1. INTRODUCTION
Welcome to Blooming Soul (“Blooming Soul,” “we,” “our,” or “the Company”). By accessing our website, booking services, purchasing products, or participating in any in‑studio, in‑home, corporate, or virtual wellness offering, you (“the Client”) agree to these Terms of Service. These Terms govern all interactions with Blooming Soul and ensure a safe, professional, and legally compliant experience.
2. NATURE OF SERVICES
Blooming Soul provides non-medical holistic wellness services, including but not limited to:
• Swedish massage (non-RMT)
• Aromatherapy and custom oil blends
• Chakra balancing
• Energy work and Reiki
• Crystal and colour therapy
• Sound therapy
• Reflexology
• Body sculpting
• Meditation and breathwork
• Corporate wellness services
• Spa parties, workshops, and group events
These services are complementary wellness practices, not regulated medical, psychological, or physiotherapy treatments.
3. CONSENT & HEALTH DISCLOSURE
Clients must disclose all relevant health conditions prior to treatment. This includes:
• Injuries, medical conditions, surgeries
• Pregnancy
• Allergies or sensitivities
• Skin conditions
• Use of medications or substances
Failure to disclose may result in refusal of service. Blooming Soul is not responsible for adverse reactions resulting from withheld information.
4. CONTRAINDICATIONS
Services may be declined or adjusted if contraindications exist, including:
• Fever, infection, or contagious illness
• Open wounds, rashes, skin irritation
• High-risk pregnancy or medical conditions
• Cardiovascular concerns
• Uncontrolled diabetes or hypertension
• Seizure disorders
• Intoxication or substance use
Blooming Soul reserves the right to terminate a session for safety reasons.
5. BOOKING & PAYMENT
All bookings must be secured through our online booking system, phone, or email.
• A deposit may be required for certain services, parties, or corporate bookings.
• Payment is due at the time of service unless otherwise contracted.
Accepted payment methods: e-transfer, credit/debit, cash, or corporate invoice.
6. CANCELLATION & REFUNDS
Individual Appointments:
• 48+ hours: reschedule without penalty.
• Less than 48 hours: 50% cancellation fee.
• Same‑day cancellation or no‑shows: full service fee applies.
Corporate, Event, or Group Bookings:
• Deposits are non-refundable.
• Cancellation within 7 days forfeits the deposit.
• Cancellation within 72 hours requires full payment.
7. RESCHEDULING
Clients may reschedule once without penalty if notice requirements are met. Excessive changes may require prepayment for future appointments.
8. TRAVEL FEES (IN‑HOME SERVICES)
Travel fees apply to in‑home services outside Shelburne, Ontario. If parking costs apply (condos, downtown areas), the client agrees to reimburse the practitioner.
9. STUDIO, IN‑HOME & CORPORATE SERVICE RULES
Studio Sessions:
• Clients must arrive on time.
• Late arrivals may receive reduced service duration with full fees applied.
In‑Home Sessions:
Clients must provide:
• A clean, safe, private space for treatment
• Space for equipment setup
• Ventilation and comfortable temperature
• Pets secured away from the treatment area
Practitioners may leave if the environment is unsafe or unsuitable.
Corporate Services:
The organisation must provide:
• A suitable room or area for wellness sessions
• Quiet environment
• Electrical access where needed
10. EQUIPMENT & PROPERTY PROTECTION
Clients are responsible for:
• Protecting Blooming Soul’s equipment from damage
• Preventing spills, burns, or stains on linens or supplies
Replacement fees may apply for damage caused by negligence.
11. SESSION CONDUCT & TERMINATION RIGHTS
Blooming Soul maintains a strictly professional environment.
Sessions will be immediately terminated if:
• Sexual, inappropriate, or aggressive behaviour occurs
• The client is intoxicated or unsafe
• Boundaries are violated
No refunds will be issued for terminated sessions.
12. CHILDREN’S SERVICES RULES
• Children under 18 require parental or guardian consent.
• A parent must remain present for all services provided to minors.
• For group events or spa parties, guardians must ensure supervision.
13. ALLERGY DISCLAIMER
Blooming Soul uses oils, herbs, crystals, smoke-free aromatics, and natural products. Clients must disclose allergies in advance. Blooming Soul is not liable for allergic reactions resulting from undisclosed sensitivities.
14. PRODUCT‑USE DISCLOSURE
All retail products (candles, oils, spiritual items, etc.) are used at the client’s discretion. Results vary and are not guaranteed.
15. INTELLECTUAL PROPERTY
All website content, branding, product descriptions, audio, meditations, and written material are the exclusive property of Blooming Soul. Reproduction, distribution, or modification without written consent is strictly prohibited.
16. MEDIA USAGE
Photos or videos may be taken only with explicit, written client consent. Clients may choose to decline without affecting their services.
17. CONFIDENTIALITY
Blooming Soul protects all personal information shared during services. Practitioners maintain strict confidentiality except where legally required.
18. PRIVACY POLICY SUMMARY
Blooming Soul collects only the information required to book appointments and provide services. We do not sell or distribute client data. Full privacy policy available upon request.
19. PAYMENT SECURITY
All online payments are processed using secure, encrypted systems. Blooming Soul does not store full credit card information.
20. CHARGEBACK PREVENTION
By booking, the client acknowledges:
• Chargebacks for services rendered or missed appointments are prohibited.
• Disputes must be directed to Blooming Soul before initiating payment claims.
21. DISPUTE RESOLUTION
In the event of a disagreement:
1. The client must notify Blooming Soul in writing.
2. Parties will attempt to resolve disputes through discussion or mediation.
3. If unresolved, disputes shall be handled in accordance with Ontario law.
22. FORCE MAJEURE
Blooming Soul is not liable for cancellations or delays caused by events beyond our control, including severe weather, illness, emergencies, or service interruptions.
23. WEBSITE TERMS & BOOKING SYSTEM DISCLAIMER
By using our website, clients agree that:
• Website content may change without notice.
• Booking system availability is not guaranteed.
• Technical errors may occur; Blooming Soul is not liable for outages.
24. TECHNICIAN SUBSTITUTION
Blooming Soul may substitute practitioners of equal qualification if necessary due to illness. scheduling conflicts, or emergencies.
25. LIABILITY LIMITATION
Blooming Soul is not liable for:
• Injuries resulting from undisclosed medical conditions
• Reactions to products or oils
• Environmental hazards within the client’s home or workplace
Clients participate at their own risk and agree to assume full responsibility for their well‑being during and after sessions.
26. GIFT CARDS & PACKAGES
• Gift cards are non-refundable and will expire one year after purchase date.
• Packages are non-transferable unless approved in writing.
• Expiry dates will be honoured according to Ontario regulations.
27. ENVIRONMENT & SAFETY RULES
Clients must ensure:
• No smoking during sessions
• Adequate lighting and safe flooring
• Pets and children do not interrupt treatments
Practitioners may refuse service if safety conditions are not met.
28. SETUP & CLEANUP RESPONSIBILITIES
Blooming Soul provides:
• All necessary equipment
• Setup and takedown for treatments
Clients agree to:
• Provide clear access to the treatment space
• Allow adequate time for setup and cleanup
29. PROFESSIONAL BOUNDARIES
All treatments are strictly non-sexual. Any inappropriate behaviour will result in immediatetermination and possible refusal of future service.
30. ENTIRE AGREEMENT
These Terms constitute the entire agreement between Blooming Soul and the Client and override any prior discussions or informal agreements.
31. AMENDMENTS
Blooming Soul may update these Terms at any time. Continued use of the website or services indicates acceptance of revised terms.
32. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
By booking with Blooming Soul, the Client acknowledges and agrees to all terms stated above.
